Subject: the Serious issue of TRAI policy of “DND” and it’s exposure to the risk of settling personnel revenge.
Dear Mr. Prime Minister,
I would like to draw your kind attention towards a very serious issue with regard to the “DND” in mobile service which if not taken care after necessary analysis of various repercussions due to the action against the person guilty -would be a huge problem for various business and self employed persons and may bring in irreparable damage to one’s business which in turn is a definite loss to the nation’s economy. Please go through the below details and help Indian public from getting scapegoats.
As per the present rule of “DND” if a person sends SMS to somebody who is registered under DND then it would be an offence and on a complaint, the person who sends SMS would be blocked from sending any further SMS temporarily and permanently after a few days. I also came to know from the authorities that after a while if the mistake is repeated then guilty mobile number would be blocked permanently from either dialling or receiving any calls.
I am confident if I manage to draw your kind attention towards this grave issue for a while, you may surely realize the seriousness of the issue and may save India’s small time and self employed business personnel from getting trapped by mis-utilizing the “DND clause” against innocent mobile users by people to settle personal issues against individuals to disturb each others business activities.
Kindly go through the following reasons one by one.
REAL ISSUE:
· The person who send SMS never know if the number to whom one is sending SMS is “DND” activated or not. ( So the person is not guilty as he is innocent and his intention is not wrong).
· There must be a provision of which a mobile user could be aware which all numbers are DND registered so that then precaution could be taken by not sending SMS to the particular numbers.
· There could be a provision introduced wherein if a mobile user sends an SMS to a “DND registered” number, then he should get a warning information from the automated computerized machine from the “Service provider” or from the “TRAI” mentioning the particular number is DND registered so that a genuine mobile user would keep himself away from sending any further SMS by deleting the particular numbers which are “DND registered”.
· The number which has placed complaint must be informed to the SMS Sender so that Sender may remove the number which complained from the list and keep sending other associates who are eagerly looking forward to receiving SMS from the person.(Only those who don’t need they may be removed that is the best option rather than blocking the Sender number permanently)
· In case if a particular number is blocked of SMS facility for his mistake of sending SMS to a “DND” number, then it must be the basic responsibility of the “TRAI” and the “Service provider” to inform the person concerned( SMS Sender) about the status with the reason about his mistake either in the form of SMS alert, call alert or computer automated calling and warning about the mistake so that he can eschew from repeating the mistake as among most of the SMS towards DND registered, 99.99% is due to the reason that one is not aware if the number to whom the sms is being sent is DND registered or not.
· Under today’s procedure if a person gets blocked due to “DND” reason he is not informed either through the telephone call or through SMS or any other means of communication. Instead he is simply blocked and the person whose mobile is blocked from sending SMS is not aware of this activity?. (This is purely unethical as when a rogue country like Pakistan continuously fire on border and infiltrate militants we keep on sending “warning” but when a sincere citizen ( Income taxpaying businessman) of India commit a mistake of sending an SMS to a DND registered mobile that too due to ignorance, his Mobile number is blocked permanently???. This is beyond our expectation as it is not an offence of serious or harmful nature. Without any warning simply blocking the facility is really ridiculous. (As per the present system Only God knows which are DND registered and which are not hence customer must get the benefit of the doubt till the time there is a system wherein DND registered are able to identify by some means during calling or SMS attempt)
· To my dismay, it is understood that for such mistake the number may get blocked permanently too for lifetime?????? That means it is the easiest way to DESTROY AND SPOIL ONE LIFETIME BUSINESS CONNECTION as nobody on earth could contact him again on the number which may put his business to a stage similar to what has happened to Jammu and Kashmir
· If the DND issue is not properly studied and rectified it may cause economic damage to India as 1000s of ignorant and innocent small-time businessman and self-employed person may become the scapegoat and many of the successful future entrepreneurs of the country may get aborted in their infant business stage itself.( Due to the number may get blocked permanently which may lead to his disconnection from lakhs of permanent and non-permanent business association and for all the advertisement on yellow pages and other similar platforms wherein the correction and updating of the number could not be possible.
· The biggest reason for this letter is for the reason that, if a person wants to make somebody(his competitor) a scapegoat then he can play some tricks and then trap somebody by various means by asking to send SMS first and then complain so that his number would be blocked and he can enjoy from the damages of his competitor. This is a very serious reason for which we must consider to amend the rule of DND in a more convenient manner.
- Of late all the major happening from banking to the social site are depending on using Mobile numbers and blocking a number from one and issueing to another after a cooling period may defenitly bring in lot of repurcussion due to the reason that Mobile number is in one way become an online face of a particular person, or digitial face of a person.
I would appreciate if following initiative is taken to save our own fellow Indian public from grave problems.
SOLOUTION:
· Make facility where in a Sender can know who is DND and who is not so that then his mistake can be considered as intentional.
· Let a warning system both by SMS, computerized automatic call or in written be given to the offender before taking the blocking step.( So that genuine person may immediately eschew repeating the act)
· After the same there must be a system through which SMS sender is told which number has objection in receiving his SMS.( It may help the Sender to remove the number from his list and the rest may continue enjoying the benefit). ( Just because one particular person is not interested in receiving information from a person should not be a reason to deprive 1000s of other who are eager to know and receive information through sms from a particular person.
· Just like there is an option for“ blacklist of incoming calls” available in mobile, the software could be updated where in “Incoming SMS too could be blacklisted” so that unwanted SMS would be filtered automatically and bounced back to the sender. (An another convenient way to make the things clear to the sender as well as receiver)
I would like to now update you that recently my number is blocked from able to send SMS since last 20 or 25 days (Exactly date when my facility was withdrawn I am not aware) as my mobile was continuously reflecting “sent” remark after my every attempt.
Now the issue is that when I contacted and complained to my service provider (Airtel) it took more than 12 days for them to confirm to me the problem of DND registered person’s complaint is the reason that my facility is blocked for SMS facility. Even during these days I kept on sending SMS for not knowing the serious issue behind it.
Then thankfully I came to know after my repeated complaint with the customer service department of my service provider and then finally they told me on 3rd of Nov 2014 that my mobile number has got permanently blocked the facility to send outgoing SMS FOR LIFE TIME. Biggest shock for my official life for no mistake of mine. I am sure some person with political difference has purposefully complained against me otherwise 90% of my customers are known to me personnely and they are only happy to receive my sms updations which are in their interest. ( Of late I had start sending my blog link www.sudeshdjvindia.blogspot.in also in my SMS and after going through the same some person with political difference must have posted complaint against my number for certain).
So I would like to humbly request you to look into the matter on top priority and take necessary decision to make amendments on the law of “DND” in the very interest of Indian business man, self employed and up coming entrepreneurs to save them from being aborted before they are made huge business assets of the country.
I am very much confident that my this appeal rather suggestion would be taken in true spirit by Indian government which is under the visionary, able and business and citizen friendly leadership of Shri Narendra Modi our Prime Minister on whom we every citizen of the country are proud of. Looking forward to see some positive steps on the same at the earliest.
