A suggestion to update Rape law. An open letter to Indian society with a copy to our Honorable PM Shri. Narendra Modi.

A girl’s or women’s self respect and dignity is always more precious than the life of ill minded animals in human disguise. Those people who cannot respect the women or girls right to their body has no way should be treated with those laws which are applicable for other natural citizens and when the issue is related to minor rapes, that too as young as 4, 3 or 2 years old... it becomes horrible. 

With great irritation and dismay, I write this to register my strongest protest for any further delay in studying, understanding and implementation of the new law by updating the existing one on the rape-related matter. Any further delay in the same will subject to more such incidence and the culprits for such incidence are not the rapist alone but the family members of the rapist too who are reluctant to disclose the unfamiliar attitude of their children to the society and to police. What  I mean to say is every parent or member of the family and society are equally responsible to identify and notify the isolated unfriendly to the society persons of every family. In a nutshell, even the close member of the rapist also should be made accountable for the inhuman act by the culprit who is a member of their family.

It is high time India come out with a stricter law towards implementation of Anti Rape policy which must be in such a way that not only the rapist who know the new law will remain away from such tendencies but also other family members of the habitual culprits will also take remedial or preventive measure by counselling the wrong member of the house or by themselves coming forward to inform the nearest police station about the tendencies of their respective members or relatives of the house.

The possible law is suggested here with which I hope would be thoroughly analyzed and implemented at the possible earliest time so that we can make one concrete step towards safe guarding our sisters and mothers of our country and I am confident once this law is implemented then automatcially the culprits will not get any support from their family (especially female members of the family) as well other male members of the family due to the fear factor which is briefed below and this would be one of the easiest way for the police and our honourable courts to identify and isolate the culprits.

Every time a rape incidence happen, the culprits rather criminals who acted are caught and are put behind bars for trial which gives them a long rope and the rape victim is left with her family (in case if she survive the ordeal)  with a long life ogeling at her with an injury on her mind and the burden of social stigma towards the society and other fellow family members.

Now the possible amendment of the law suggested by me is the confisication of the property of the culprit if any availble in the name of the victim.

• The property of the culprits must be attached with immediate effect and it must be auctioned to raise fund and the same must be utilized to finincial compensation  and re habilitation of the victim.
• In case the property of the culprit is not on individual name but a common property with other partners in the form of close relatives, then in such case the property must be freezed from selling and buying till further notice with matter in court.
• If the culprits family member want to avoid the embrassing situtation due to no fault of theirs, then for the same the family members or relatives of the culprit must have informed the police in advance in the form of  a complaint against the culprit whose charcter, advances or attidtude towards the society is not good like that. ( Just imagine this is one of the natural way for isolating the habitual culprits from not only society but among their family members and what else could be better than this law?. According to this law, if the family members intimate the concerned nearest police station in writing, in advance, with respect to the suspicious or known criminal habits, attitude or approaches must come forward and lodge a complaint, then their property would be safe, but in that case police can take strongest of action against the culprit as they got the evidence from their own family members). Before further action police can cross verify the status of the person from society too in curtain discussion manner)
• If the family members of the culprit had made such an offical complaint with the police station and obtained a receipt for the same then the property of culprit where other members also enjoy a share will get some relaxation with regard to strictness. (How much relaxation or flexibility and under what condition must be decided by the experts)
• In the case of the above complaint of the family members against their own family member, then it is the responsible of the police to take control of the situation by meeting the person, counselling him, threatn him with consequences, educate him about the repurcussion if he doesn’t improve his attitude etc.
• The law must be merciless for all gang rapists.( As it is not due to any sudden urge but it is well planned and circumstances are designed to trap the victim)
• The law must be highly merciless and if possible capital punishment for those who has raped more than once in his life time. (Even if the capital punishment suggestion come forward for even a single rape is welcome).

The root cause of all issues related to law is due to the reason that a culprit is at privilage to cross all barriers to break the law and he can go to any extent to express himself, but a police or a comman man cannot cross the so called barrier and he cannot break the law or can’t express himself in the same manner to defend himself.???. During saving oneself from the culprit if some thing untoward happens then the police and other laws almost spoil the life of the common man. So some strict law as briefed above as well as some law towards giving liberty for comman man to defend oneself must be provided.

On the basis of the above only the rape menace could be curtained. This is very much important due to the reason that unlike isolated rape cases which comes on time to time which happened to be between two known to each other friends, or lovers, etc are different from those rapes which are committed purposefully, planned, designed, with circumstances created, that too on group basis which is showing more than just the lust of sex, it is a sadist mentality of the sick minded people who are getting bolder every day after day due to more than one reason.

I am 100 percent confident that the culprits are doing this act without any fear of the police or other system in place is only due to the reason that most of the rape vicitm don’t disclose the ordeal to any one due to social stigma attached to it and due to this the culprits become more bold and they start enjoying the situtaion and it is more like a fun for them. It must be true that those who are rapist are habitual culprits and there must be some strict provision for those rapist who has taken women as an object of pleasure.

Please remember every day in India rape is taking place some get noticed some escape un noticed, but I would like to tell you a naked truth here, every day when a new person becomes victim, she or her family members were not a victim a day before just like you and me who are reading this article now. Every day some victim is added who was not a victim a day before. So fools wait for their turn to experience and understand a mistake but wiser man always learn from others mistake and make it their own experience .I have seen lot of hue and cry in country on time to time when ever some serious issue of rape surfaces. So I humbly request to support this letter and share it maximum among your educated friends and other members of the society so that let them read it and help towards the cause of amendment in rape law at the earliest.

Only this law could apply some practical differences to the rapist and it is the need of the hour. Share it now and contribute to make it a law.
